Do they inflict quantifiable harm? In Snyder v Phelps, the Supreme Court ruled that protests can be used for unlawful acts of endangerment. Essentially, the emotional costs of their speech are not subject to legal action of any kind, despite this they can drive their targets to suicide with a constant stream of god hates you and you're going to hell. In the case of Hustler Magazine v. Falwell, there must be malice and the presentation of falsehoods as fact to constitute emotional harm. In the case of Westboro Baptist Church, neither exists. Westboro Baptist Church's remarks and demonstrations may be disgusting, repugnant, repugnant and despicable, but they are in no way unprotected speech, nor are they subject to action against them for their speech. They did not commit any quantifiable harm, nor any illegal act that they hated. The same protections that are supposed to ensure members of the LGBTQ community have the ability to exist peacefully provide the Westboro Baptist Church with the legal protections to spread contempt. All one can do is wait for time to show them the vile organization as they are and a lesson to be learned
